Obsidian Psychiatry LLC ("Obsidian," "we," "us," or "our") respects your privacy. This policy explains how this informational website operates, how information may be handled when you contact us or request services, and the terms that apply when you use the website.

 

This website policy is separate from Obsidian's Notice of Privacy Practices, which explains how protected health information may be used and disclosed and describes patient rights under applicable health care privacy laws.

WEBSITE PRIVACY POLICY

Information collected through this website

This is an informational, brochure-style website. It does not use embedded website forms to collect consultation information and does not provide Wix-based patient accounts, bookings, payments, chat, or document uploads.

The website is hosted by Wix. Wix automatically processes limited technical information needed to deliver, secure, maintain, and report basic use of the website. This may include an Internet Protocol address, browser and device information, pages requested, referring page, date and time of access, essential cookie identifiers, and security, diagnostic, and server-log information.

Obsidian does not use this technical information to create health-interest profiles, target advertising, or make decisions about clinical eligibility.

Consultation requests and secure platforms

When you select a consultation or patient-portal link, you leave this public website and are directed to PracticeQ/IntakeQ, Obsidian's secure intake and electronic health record platform. Information entered there is not submitted through Wix. It is processed on Obsidian's behalf and handled under applicable health care privacy laws and Obsidian's Notice of Privacy Practices.

Obsidian may also use Spruce for secure patient communication. Established patients should use PracticeQ/IntakeQ or Spruce for clinical communication as directed by the practice. Creating an account or submitting a consultation request does not guarantee acceptance as a patient.

Email, telephone, and other communication

If you contact Obsidian by email, telephone, fax, or another communication method, we may receive your contact information and the contents of your communication.

Standard email and ordinary text messaging may not be fully secure. Do not include detailed medical information, sensitive health history, or urgent clinical concerns in email. Email may be used for general questions and administrative or basic scheduling communication. Do not use email, voicemail, the patient portal, or the consultation process for emergency or time-sensitive communication.

Cookies, analytics, and embedded services

The website uses essential cookies and Wix's built-in operational and basic traffic-reporting functions. Obsidian has not added marketing integrations, Google Analytics, Meta Pixel, advertising pixels, retargeting tools, or session-recording technologies.

Some pages may use Google-hosted fonts or an embedded Google map. When those elements load, Google may receive technical information such as your IP address, browser or device information, the requested page, and the time of the request. Obsidian uses these elements for text display and directions, not for advertising or health-interest profiling. Google's handling of information is governed by its own privacy notices and terms.

Obsidian does not sell or rent personal information or consumer health data and does not use website information for targeted advertising.

How information may be used or disclosed

Limited website and communication information may be used to deliver and protect the website, diagnose technical problems, respond to questions, administer prospective or established patient relationships, comply with legal and regulatory obligations, and establish, exercise, or defend legal rights.

Limited information may be disclosed to service providers that support the website or practice systems, at an individual's direction, when required or permitted by law, to prevent fraud, misuse, or a security threat, or as part of a lawful transfer or reorganization of the practice. Service providers that create, receive, maintain, or transmit protected health information on Obsidian's behalf are subject to appropriate privacy and security obligations, including a Business Associate Agreement when HIPAA requires one.

Retention

Technical website information is retained according to applicable Wix settings, service terms, security needs, and legal requirements. Administrative communications may be retained as reasonably necessary to respond, document the communication, meet legal obligations, or protect the practice's rights.

Patient records and protected health information are retained under applicable clinical, insurance, and recordkeeping requirements. A request to delete ordinary website information does not necessarily require or permit deletion of a medical record.

HIPAA and patient privacy

Obsidian follows applicable federal and state health care privacy laws when handling protected health information. Patient information used for intake, treatment, clinical communication, documentation, prescribing, billing, and records is handled through systems designated for those purposes.

Patient rights and more detailed information are described in Obsidian's Notice of Privacy Practices. This website policy is not a substitute for that Notice.

WASHINGTON CONSUMER HEALTH DATA NOTICE

This section applies to information covered by the Washington My Health My Data Act. Protected health information and certain health care information governed by HIPAA, Washington health care privacy law, or 42 CFR Part 2 may be exempt from that Act and are handled under those laws and Obsidian's Notice of Privacy Practices.

Categories of consumer health data and purposes

A visit to a psychiatric practice website may suggest an interest in mental health services. Consumer health data may therefore include technical information linked or reasonably linkable to a person or device that visits this website, as well as information a person voluntarily includes in an administrative email, telephone call, or other communication.

We use this information only as necessary to provide a service the person requests, respond to the person, operate and secure the website and practice systems, keep appropriate administrative records, comply with law, and protect legal rights.

Sources

Sources may include the individual, the individual's browser or device, Wix, Google-hosted fonts or maps, and communication, intake, or patient-platform providers acting on Obsidian's behalf.

Categories shared and recipients

Technical website information may be shared with Wix and Google when they deliver hosting, fonts, or maps. Administrative contact information and communication content may be shared with email, telephone, fax, PracticeQ/IntakeQ, or Spruce providers when necessary to respond or provide a service the individual requested.

Obsidian has no affiliates with which it shares consumer health data for independent purposes.

Obsidian does not sell consumer health data or share it for advertising. We do not collect, use, or share additional categories of consumer health data, or use disclosed categories for additional purposes, without providing any notice and obtaining any consent required by law.

Washington consumer rights

Where the Washington My Health My Data Act applies, a Washington consumer may have the right to:

• Confirm whether Obsidian collects, shares, or sells consumer health data concerning the consumer.

• Access applicable consumer health data and receive information about applicable disclosures.

• Withdraw consent from future collection or sharing.

• Request deletion of applicable consumer health data.

• Appeal a refusal to act on a request.

To submit a request, email info@obsidianpsych.com with the subject line "Washington Consumer Health Data Request." Do not include medical details in the email. Obsidian may move the request to a secure method to verify identity and respond. We will respond without undue delay and within 45 days, subject to any extension or other provision allowed by law.

To appeal a refusal, email the same address with the subject line "Appeal - Washington Consumer Health Data Request." We will respond to an appeal in writing within 45 days. If an appeal is denied, we will provide information about contacting the Washington Attorney General.

Data security

Obsidian uses reasonable administrative, technical, and organizational safeguards appropriate to the information involved. No website, email system, or Internet transmission can be guaranteed to be completely secure. Use PracticeQ/IntakeQ or Spruce, as directed, for consultation information, intake materials, patient records, and clinical communication.

Service area and eligibility

Website descriptions do not guarantee eligibility, acceptance, or appointment availability. Clinical services are provided only when clinically appropriate and when the provider is legally authorized to provide care based on the patient's location.

Telehealth is available for patients located in Oregon and Washington, subject to provider availability, licensing, clinical appropriateness, and practice policies.

No emergency or crisis services

This website, email address, consultation process, and patient portal are not emergency or crisis-response services and should not be relied on for an immediate response.

For a medical or mental health emergency, call 911 or go to the nearest emergency department. For suicidal crisis or emotional distress in the United States, call or text 988.

Accuracy and availability

Obsidian makes reasonable efforts to keep website information accurate and current but does not guarantee that all content is complete, current, or error-free. Services, availability, insurance participation, policies, and fees may change. Website access may be interrupted for maintenance, security, or circumstances outside Obsidian's control.

Third-party platforms and links
